Polo 4PL Logistics / Polo 4PL Inc.

These Terms & Conditions (“Terms”) govern the use of services provided by Polo 4PL (“Company,” “we,” “us,” or “our”) including freight brokerage, transportation management, logistics coordination, warehousing coordination, and related supply chain services. By engaging our services, accessing our website, or tendering freight to us, you (“Customer,” “Shipper,” or “Client”) agree to be bound by these Terms.

1. Scope of Services

Polo 4PL operates as a freight broker and logistics coordinator, arranging transportation of freight through licensed third-party motor carriers. We do not operate as a motor carrier and do not take possession of cargo at any time unless explicitly stated in a written agreement.

2. Acceptance of Terms

By requesting a quote, booking a shipment, tendering freight, or otherwise using our services, you acknowledge and agree to these Terms. These Terms apply to all shipments unless a separate written contract signed by an authorized representative of Polo 4PL expressly supersedes them.

3. Independent Contractor Relationship

All transportation services are performed by independent third-party carriers. Polo 4PL is not liable for acts or omissions of carriers, subcontractors, or agents used to fulfill transportation services.

4. Customer Responsibilities

The Customer agrees to:

Provide accurate shipment details (weight, dimensions, commodity, value, etc.)
Properly package and label all freight
Ensure compliance with all applicable laws and regulations
Disclose any hazardous or restricted materials prior to booking
Ensure freight is ready for pickup at scheduled times

Failure to provide accurate information may result in delays, additional charges, or cancellation.

5. Prohibited Goods

Customers may not tender shipments containing:

Illegal goods or contraband
Hazardous materials not properly declared or compliant
Firearms, explosives, or restricted substances (without prior written approval)
Stolen or counterfeit goods
Any goods prohibited by federal, state, or international law

6. Rates, Charges & Payment Terms

All rates are subject to change prior to booking confirmation.
Payment terms are net as agreed on invoice (or prior written agreement).
Late payments may incur interest, collection costs, and administrative fees.
Customer is responsible for all accessorial charges including detention, storage, demurrage, re-delivery, or re-consignment.

7. Liability & Cargo Claims

Liability for loss or damage rests with the transporting carrier, subject to their governing bill of lading and insurance policy.
Polo 4PL is not liable for indirect, incidental, or consequential damages.
All claims must be submitted in writing within the carrier’s required claim filing period.

8. Transit Times

Transit times are estimates only and are not guaranteed unless explicitly stated in writing. Delays caused by weather, traffic, customs, carrier issues, or force majeure events are not the responsibility of Polo 4PL.

9. Force Majeure

Polo 4PL shall not be held liable for delays or failure in performance due to events beyond reasonable control, including but not limited to natural disasters, strikes, port congestion, war, pandemics, or governmental actions.

10. Limitation of Liability

To the maximum extent permitted by law:

Polo 4PL’s liability is limited to the amount of brokerage fees earned on the shipment in question.
Under no circumstances shall Polo 4PL be liable for lost profits or business interruption.

11. Insurance

Cargo insurance is not automatically included unless explicitly purchased or arranged in writing. Customers are encouraged to secure their own cargo insurance coverage.

12. Right to Refuse Service

Polo 4PL reserves the right to refuse, cancel, or suspend service at any time for:

Non-compliance with terms
Suspicious or high-risk shipments
Non-payment or credit issues
Operational constraints

13. Documentation

Customers are responsible for ensuring all required shipping documentation is accurate and complete, including but not limited to:

Bill of Lading (BOL)
Commercial invoices
Customs documentation (if applicable)
Import/export filings

14. Indemnification

Customer agrees to indemnify and hold harmless Polo 4PL, its officers, employees, agents, and affiliates from any claims, damages, or liabilities arising from:

Misdeclared shipments
Illegal or prohibited cargo
Customer negligence
Breach of these Terms

15. Website Use

All content on the Polo 4PL website is for informational purposes only. We do not guarantee accuracy or completeness of information and may update content at any time without notice.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

17. Changes to Terms

Polo 4PL reserves the right to update or modify these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.

18. SMS Terms and Conditions

By opting in to receive SMS messages, you agree to the following: receive SMS messages from Polo 4PL to provide updates and important information. Message frequency may vary, and message and data rates may apply. You can opt out anytime by replying STOP. For help or more information, reply HELP.

Opt-In – Consent is obtained before sending messages. Subscribers will receive a confirmation message upon opting in:

Opt-Out – Reply STOP at any time to unsubscribe. You will receive a confirmation message:
